1. Introduction

Welcome to Wave Cam (“we”, “our”, “us”). These Terms of Service (“Terms”) govern your access to and use of the Wave Cam platform, website, and related services (“Platform”).By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

2. Description of Service

Wave Cam is a surf photography marketplace that connects photographers who upload and sell surf photos and videos with surfers who can browse and purchase them.The Platform serves as a facilitator between photographers and surfers but does not own or control the content uploaded by photographers.

3. User Accounts

• You must create an account to upload, sell, or purchase photos/videos.
• You agree to provide accurate and complete information during registration.
• You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
• You must be at least 18 years old to use the Platform.

4. Photographer Responsibilities

• Photographers retain ownership of the content they upload.
• By uploading photos or videos, photographers grant Wave Cam a non-exclusive, worldwide, royalty-free license to display and sell their content on the Platform.
• Photographers are solely responsible for ensuring they have the rights and permissions to publish and sell their content, including any identifiable individuals.
• Photographers must comply with all applicable copyright and privacy laws (including GDPR in Europe).

5. Complaints and Takedowns

• If a surfer or any individual appears in a photo or video and wishes to have it removed, they should contact the photographer directly using the details provided in the listing.
• If the photographer fails to respond or resolve the issue, users can contact Wave Cam at support@wavecam.co, and we will review the complaint in accordance with our policies.
• The Platform reserves the right to remove or disable access to any content that violates these Terms, privacy laws, or is considered inappropriate, without prior notice.

6. Purchases and Payments

• All transactions are processed securely via Stripe.
• Wave Cam charges a 18% commission on each sale.
• Prices are set by photographers and include applicable taxes, unless stated otherwise.
• Once purchased, digital downloads are generally non-refundable, except in cases of technical error or confirmed violation of these Terms.

7. Platform Use

You agree not to:

• Upload content that is illegal, defamatory, obscene, or infringes on others' rights.
• Attempt to hack, disrupt, or misuse the Platform.
• Use the Platform for any commercial activity other than as permitted.

Wave Cam reserves the right to suspend or terminate accounts that violate these Terms.

8. Intellectual Property

• All intellectual property rights in the photographs and other content published on the Platform belong to the respective photographers.
• Users who purchase content receive a limited, non-exclusive license to use the content for personal purposes only.
• Any commercial use, reproduction, resale, or distribution of the content without the photographer's explicit written consent is strictly prohibited.
• All trademarks, logos, and software associated with Wave Cam remain the property of the company.

9. Limitation of Liability

• Wave Cam acts solely as an intermediary between photographers and surfers.
• We are not liable for:
• The accuracy, legality, or quality of uploaded content.
• Any disputes between users.
• Loss of data, profits, or damages resulting from the use or inability to use the Platform.

10. Account Termination

Wave Cam may suspend or delete any account that:

• Violates these Terms,
• Uploads illegal or harmful content, or
• Engages in fraudulent activity.
• Users may delete their accounts at any time by contacting support.

11. Data Protection (GDPR Compliance)

• Wave Cam complies with the General Data Protection Regulation (GDPR).
• We only collect data necessary to operate the Platform and process transactions.
• Users can request access, correction, or deletion of their personal data by emailing support@wavecam.co.

12. Changes to Terms

• We may update these Terms from time to time.
• Any changes will be published on this page with the updated “Effective Date.”
• Continued use of the Platform after such updates constitutes acceptance of the revised Terms.

13. Governing Law

• These Terms are governed by the laws of Portugal and the European Union.
• Any disputes arising shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal.
